Welcome to Sail! Sail App, its website, and other related services are developed and provided by HK UMAIL LIMITED (hereinafter referred to as “we,” “our service,” or “the App”). These Terms of Service constitute an agreement between you and us. If you do not accept or agree to these terms, please do not access or use this website and/or application. Your use of the service constitutes “explicit consent” as defined by applicable law.
If you lack full civil capacity due to age, mental condition, or other reasons, you may not use our services.
You must be at least 18 years old or the age of majority in your jurisdiction (whichever is higher) to use this service.
You are responsible for ensuring that your use of the service complies with applicable laws and regulations. You agree to fully comply with all relevant laws and regulations while using the service. If any applicable law prohibits you from using or planning to use this service, you must not use it.
We collect, use, store, and share your personal information in accordance with these Terms and our Privacy Policy (please refer to the Privacy Policy for details).
We maintain a zero-tolerance policy toward any form of child sexual abuse or exploitation (CSAE). Any user who fails to comply with Sail’s policy for protecting minors (under 18 years old), as described below, will be removed from Sail and may face legal consequences.
Prohibited Activities
The platform strictly prohibits the following:
Content Creation or Sharing:
Uploading, sharing, or distributing any images, videos, text, or other media depicting child sexual abuse or exploitation.
Creating or participating in groups, chat rooms, or communities that promote or glorify such behavior.
Grooming and Enticement:
Attempting to establish inappropriate contact with minors for exploitative or abusive purposes. Manipulating or coercing minors into sharing explicit content.
Illegal Use of the Platform:
Using the platform to identify, contact, or communicate with minors for purposes of abuse or exploitation.
Promoting or facilitating trafficking or other criminal activities involving minors.
Prevention and Enforcement
To ensure compliance with this policy, we have implemented the following measures:
Content Monitoring: Automated systems and human moderators proactively monitor illegal or inappropriate content. Suspicious content may be flagged, reviewed, and reported for investigation. User Reporting Tools: Users can report suspected violations through in-app reporting tools or our support channels. Cooperation with Law Enforcement: We cooperate with law enforcement authorities to investigate and address violations, including sharing information as required by law. Account Penalties: Accounts engaged in prohibited activities will be permanently banned, and related data may be retained for legal proceedings.
We encourage all users to be vigilant community members by:
Immediately reporting any suspicious behavior or content. Avoiding the sharing of minors’ personal information to protect their privacy and safety. Learning about and promoting awareness of online child safety.
Any violation of this policy will be treated with the utmost seriousness. We are committed to maintaining a safe and abuse-free environment for all users.
“Content” refers to any materials you generate, upload, reproduce, post, or distribute while using the service, including but not limited to account avatars, names, user profiles, registration information, identification documents, or any text, audio, images, videos, graphics, or other forms of messages and links sent, received, or auto-replied to, as well as other content generated from the use of your account or the service.
You acknowledge and agree that you must not—and guarantee that your content and behavior will not—do any of the following:
Contain offensive or pornographic material in your profile
Contain sexually suggestive or sexual content (e.g., implying casual sex, prostitution, or descriptions of genitalia)
Involve others’ privacy, personal information, or data (e.g., detailed addresses or job descriptions)
Insult, defame, or otherwise infringe upon the legal rights and interests of others
Infringe upon others’ reputation, portrait, intellectual property, trade secrets, or other lawful rights
Disseminate obscene, pornographic, gambling-related, violent, murderous, terrorist, or criminally inciting content
Incite racial hatred or discrimination, or undermine ethnic unity
Incite illegal activities
Organize assemblies, associations, demonstrations, or gatherings to disrupt public order
Spread rumors, disrupt public order, or endanger social stability
Contain any other information prohibited by laws or administrative regulations
If you violate these terms or any applicable laws or regulations, we reserve the right to restrict, suspend, or terminate your account at our sole discretion and to decide whether to restore your access.
We have the right—but not the obligation—to handle illegal or prohibited content or behavior in accordance with these Terms. If another user infringes upon your lawful rights, you may file a complaint with us, and we will process it in accordance with the law. If your content violates laws or infringes others’ rights, Sail reserves the right to delete, block, or disable access to such content.
Any content you disseminate through the service does not represent our views or policies, and we bear no responsibility for such content.
You are solely responsible for your interactions with other users of the service. We do not conduct criminal background or other checks on users but reserve the right to do so at any time. We make no representations or warranties regarding users’ conduct, information, or statements. You agree to take reasonable precautions when interacting with other users. We are not responsible for mediating disputes between users.
We do not claim ownership of your content. However, you grant us a perpetual, worldwide, royalty-free, non-exclusive license to use, distribute, reproduce, modify, translate, adapt, publicly perform, and publicly display your content for the purposes of providing the service, as well as any purposes permitted by our Privacy Policy, and to publish, display, distribute, and store your content as necessary for those purposes. You also grant other users the right to access your content through the service.
You understand that the technical processing and transmission of data related to your content may involve: (i) transmission across various networks; and (ii) modifications to conform to the technical requirements of servers, networks, or devices.
You must ensure that you own or are legally authorized to use any content you upload or publish, and that such content does not infringe on the lawful rights of any third party (including but not limited to portrait rights and reputation rights).
We reserve the right to remove any allegedly infringing content upon notice from the rights holder or relevant parties. You are fully liable for all legal claims arising from your infringement. If your infringement causes any losses to us or our affiliates (including but not limited to financial or reputational loss), you shall fully compensate us and our affiliates.
You may voluntarily publish works you fully own the copyright to on other platforms, but without our prior written consent, you may not directly or indirectly use or authorize any third party to use any content from the App in any form.
We may offer paid services for which you must comply with the relevant agreements. We may adjust or modify the pricing and payment methods of paid services as needed and may begin charging for previously free services. Any changes will be announced or published on the relevant pages. If you do not agree to such adjustments, you should stop using the service.
Once account recharge is completed, the corresponding amount will be credited to your account. We do not offer refunds or cash exchanges.
If you request account deletion, we will not issue any refunds. Please consider carefully before making such a request.
The App is provided on an “as-is” basis. We, our affiliates, and our respective officers, directors, employees, agents, partners, and licensors make no express, implied, or statutory warranties or conditions of any kind.
We make no warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, integration, interoperability, or quiet enjoyment.
We make no representations regarding the accuracy, completeness, timeliness, or non-infringement of any information or other content accessible through the service. We do not guarantee that service functions will be uninterrupted or error-free, that defects will be corrected, or that the service or the servers providing it are free of viruses or other harmful components. Some jurisdictions do not allow exclusion of implied warranties, so the above disclaimers may not apply to you.
We reserve the right to update or modify these Terms of Service at any time. We will notify you of any updates through in-app notifications, pop-ups, email/SMS, or in-app announcements. If you continue to use the service after the updated policy takes effect, you will be deemed to have read, understood, and agreed to the updated policy and to be bound by it.
