This Privacy Policy is developed by Sail (hereinafter referred to as "the App", "we", or "our") and is incorporated into and governed by our Terms of Service. By accessing or using the Sail mobile application (hereinafter referred to as "the App") or any related services (collectively, "the Services"), you acknowledge that you have carefully read, fully understood, and unconditionally agreed to the terms of this Privacy Policy. If you do not agree to any terms of this Privacy Policy, please immediately stop using the Services.

When you use our Services, we may collect your data, as described below. When you register and use your account, we collect your data to provide the services. The types of data we collect depend on how you use our Services.

2. Personal Data We Collect

When you use our Services, such as accessing or using our applications, installing applications on your device, or registering a Sail account, we collect certain personally identifiable information to provide you with these services. More details are below.

2.1. Creating Your Account and Providing Information

When you install our services and/or register for a Sail account on your device, we may collect your personally identifiable information and/or non-personally identifiable information. Registration and account data are divided into two categories:

Required Information:

Basic information, such as your gender, age, nickname, profile picture, date of birth, and phone number. This information helps us connect with other users and enable application features.

Optional Information:

Other information you choose to share, such as photos/videos, personal descriptions, or interests.

2.2. Location Information

When you use our services, we may collect your location information. With your explicit consent, we may also collect your precise location information using methods including GPS, wireless networks, base stations, Wi-Fi access points, and other sensors (such as gyroscopes, accelerometers, and compasses).

2.3. Activity Logs

When you browse content on our services or otherwise interact with our services, we receive relevant information, which we call “log data.” For example, we may receive information about you when you visit our website, log in to our services, interact with our email notifications, or authenticate with third-party services using your account.

Technical Details: IP address, device type, browser, operating system.

Usage Patterns: Pages visited, links clicked, search terms, interactions with other users.

Metadata: Date/time of connection, location of match occurrence.

2.4. Data Collected During App Use

Device Information – Sail may collect and store device information you use to install and access the app, such as device model, unique identifier, IP address, device capabilities, and page view statistics.

Your Activity – Sail may collect and store information about your and other users' activities within the app. We need access to your device to use and copy photos as your profile picture and any photos/media files you choose to share for display within the app. We also need access to your camera and microphone to record video/audio (including music files) to provide services while you use the app. This also helps us meet compliance requirements, such as preventing users under 18 from accessing the app.

Content You Share – Sail allows you to share your profile, interests, text messages, photos, screenshots, videos, audio, and other communications with other users. If you choose to share this content, it will be stored on our servers. Please note that if you share this content with other Sail users, we may not be able to delete it or block access for others. By sharing such content, you agree that you may lose control over how it is used, and that it may become public (depending on your or other users' actions). Sail is not responsible for how others use the content you share.

Content You Create – We may also collect and store any user-generated content (such as photos, screenshots, comments, interests, and other information) that you create or publish on the app (“User Content”).

Transaction Information – To complete a transaction, you will be asked to provide payment information. This information will be securely transmitted to a third-party vendor or merchant for processing your purchase. Sail may process or store your payment information, but we may also store information about your purchases, including date, time, amount, and other behavioral data, such as your purchase history.

Bug Report Information – If the app crashes or malfunctions, we collect bug reports to help improve app stability. These reports typically do not contain personally identifiable information. They contain detailed information such as device type, version, device identifier, time the error occurred, the features being used, and the state of the application when it crashed.

An error has occurred. This information is used only for investigating and fixing the error.

2.5. Data Collected When You Visit Our Apps

We may use online tracking technologies, such as pixel tags, web beacons, and similar tools, to automatically collect the following information:

Your visits to our apps, including your browsing history, time spent on the app, and frequency of visits.

Location data provided by your mobile device or other devices when you interact with our apps, such as your IP address and approximate geographic location.

The device you used to browse our apps, including your device ID, operating system, device type, browser version, mobile app crashes, system activity, and any third-party websites you visited before interacting with our services.

You can choose to disable any of these online tracking technologies. These technologies help us ensure secure logins, leverage data analytics to improve our services, and develop new features for users.

2.6. Age Restriction

This service is not intended for children or individuals under the age of 18 (18), and we do not knowingly collect any personally identifiable information from users under the age of 18 (18). However, we do collect your age information to ensure that underage users cannot use our service, thereby helping us maintain the security of our platform. We also work with third parties to ensure that our applications have accurate age information. If we discover that we have inadvertently collected personally identifiable information from users under the age of 18 (18), we will immediately delete that information from our records. If you are under the age of 18 (18), please do not use this service. We collect your gender and birthdate solely to provide accurate matching for social connections.

3. Your User Profile

You can access, manage, and update your user profile (“Your Profile”) on the application at any time. This includes details such as your avatar and video, name, interests, bio, language, and birthday, all of which can be shared with your Sail contacts. Please ensure that your profile contains only what you want to share.

4. Use and Purpose of Personal Data

We adhere to the principle of data minimization when collecting and using your data, ensuring that it is used only for the purposes described below. We will process your data for the purpose of providing services and other related business activities, including:

4.1. Providing you with services, including:

- Connecting you with other app users.

- Enabling you to share your profile with other users within the app.

- Allowing you to send pictures and videos through the app.

- Displaying the names of people you communicate with and showing your name to people you interact with within the app.

- Providing certain features, such as premium services.

- Enabling you to contact us.

- Assisting with third-party payment processing.

- Providing and improving advertising services, including serving personalized ads (where permitted) and measuring their effectiveness.

- Conducting analytics to improve your connection, provide other services, and update our services.

4.2. To help us manage your account and profile on the application, including:

- Creating and updating your account.

- Sending you administrative notifications, reminders, and communications related to your use of the application.

- Facilitating networking and providing other users' location or interest information.

- Use the data we possess to develop, test, and improve our services, including through surveys, research, statistics, and user behavior analysis (e.g., purchase records, online interactions).

- Process payments for transactions made through third-party service providers.

- Communicate with you regarding our services and inform you of our policies and terms.

- Respond to your inquiries when you contact us.

- Share data with third parties and our group companies to fulfill our contractual obligations.

4.3 To promote security, integrity, and assurance:

- Use the information we possess for auditing, compliance, control, security, and risk management purposes. This includes verifying accounts and activities, combating harmful behavior, detecting illegal activities, maintaining service integrity, and promoting security. We use a combination of automated detection technology and human review to investigate suspicious activity or policy violations and allow you to report any issues.

4.4 For business management purposes, including data and record management:

- To establish, exercise, and defend our legal rights.

- To comply with legal, regulatory, and reporting obligations.

- To ensure user security through content moderation.

- For corporate transactions involving Sail, such as the sale of business units, acquisitions, mergers, or asset sales.

- For fulfilling our contractual obligations to you and other parties.

- For fulfilling our obligations to group companies and third parties.

4.5. For connecting information across our services:

- We will combine data and information about you on Sail and your activities.

We will obtain information from other applications and services to provide a more integrated and personalized experience.

4.6. For analytical purposes:

- We may anonymize or aggregate your personal data for analytical purposes. This helps us improve existing services, detect fraud, analyze usage trends, and provide third-party service providers with basic statistics on how Sail users use their services.

5. Legal basis for processing your data

When you use our services, we process your data based on various legal bases. Regarding these legal bases, we process your data based on one or more of the following legal bases:

5.1 With your explicit consent

We will not process your personal data without your explicit consent. We will only process your personal data if you consent to it for a specific purpose, such as providing our services and other items you request.

5.2 Without Your Explicit Consent

Notwithstanding the foregoing, please note that we may not process your personal data without your explicit consent if one or more of the following conditions are met:

• It is expressly required by law;

• Processing is necessary to protect the life or personal safety of you or any other person who is unable to interpret their consent due to physical disability or whose consent is not legally recognized;

• Processing of your personal data is necessary and directly related to the conclusion or performance of the contract (i.e., the Terms of Service) between you and Sail;

• Processing is necessary to fulfill Sail's legal obligations;

• You have disclosed your personal data;

• Processing is necessary to establish, exercise, or protect any of your rights;

• Processing is necessary for Sail's legitimate interests, provided that such processing does not infringe upon your fundamental rights and freedoms.

6. Sharing with Third Parties

We may share your personal data with group companies, suppliers, and service providers to assist in our business operations, such as providing technical infrastructure, analyzing service usage, providing customer service, security services, assisting with payments, or conducting investigations. Furthermore, if we transfer your personal data overseas, we will ensure appropriate safeguards are in place, or provide a written commitment to ensure adequate protection, and obtain authorization from relevant authorities.

In addition, our products may include third-party software development kits (SDKs) or similar tools to enhance product functionality. Using these services indicates your consent to their data collection and processing methods, which may involve methods such as code embedding or component integration. These third-party services are subject to their own privacy policies, which are independent of our privacy policy and may involve sharing your data according to their terms.

To better protect your personal information, we recommend that you review their privacy policies before using these third-party SDKs. If you have any concerns or discover potential risks, we recommend that you stop using these services and notify us. Being vigilant and taking proactive measures will help ensure a safer experience when using our products.

7. Parties You May Choose to Share User Content With

Any information or content you voluntarily disclose or post on the application (such as your user content) will be public. Once shared or made public, this content may be viewed, forwarded, or copied by others, and it may be impossible to prevent its further dissemination.

Even if you delete any user content you created or posted on the application (such as screenshots), copies of this content may still exist in the application's cache or archive pages, or other users or third parties may have saved or copied this content (e.g., through platforms such as Facebook).

Any personally identifiable information you share on the application with other users via SMS, photos, videos, or live messages may be viewed and used by others. Sail is not responsible for any use or misuse of information you choose to share or submit.

8. Account Deletion

You can choose to delete your account at any time. To completely delete your account and all associated data, go to Profile > Settings > Delete Account. Follow the prompts to confirm the deletion. If you request that we delete your account, we will make commercially reasonable efforts to remove your data from our servers, subject to any applicable laws or other requirements that require the retention of certain personally identifiable information records of you. Please note that deleting your personally identifiable information from our database may prevent us from continuing to provide you with services.

9. Security

Protecting your privacy and personal data is Sails top priority.

Sail takes significant measures to ensure the privacy and security of all personally identifiable information you provide. We stress-test our systems to help us improve our services. Personally identifiable information may only be accessed by Sail and its group company employees, contractors, agents, and third-party service providers, and only for purposes necessary to provide, operate, develop, maintain, support, or improve services, or for any other purposes described in this Privacy Policy.

Sail employs appropriate technical and physical security measures, including password protection, access logs, and system monitoring, to protect user information from unauthorized disclosure, misuse, or alteration.

However, due to the inherent nature of the internet and related technologies, we cannot guarantee absolute protection against loss, misuse, or alteration of information under our control.

Your personal data may be stored and processed in any country where Sail, its group companies, or our service providers have facilities. Sail reserves the right to transfer your personal data across borders for the purposes of data sharing or disclosure described in this Privacy Policy. We share infrastructure, systems, and technologies to provide a consistent, relevant, and secure experience across all group applications. We will also process your information internally within the Group in accordance with applicable laws and our internal terms and policies.

10. Data Retention

We will retain your personal data only for the time necessary to achieve the purposes described in this Privacy Policy, unless a longer retention period is required by law or necessary for our legitimate business purposes. By using our application, you agree to receive electronic communications and/or announcements regarding the revised Privacy Policy, and acknowledge that such electronic communications or announcements constitute notification of your Privacy Policy.

If we make material changes to this Privacy Policy, we will notify you by posting the revised Privacy Policy, posting a notice on our application, displaying a pop-up window within our application, or as required by law. You agree to review this Privacy Policy periodically for any changes. Your continued use of the Service after we post the revised Privacy Policy or post a notice on our website constitutes your acceptance of the updated Privacy Policy. If you do not agree to the terms of the revised Privacy Policy, you must cease accessing or using our Service.
